NewsOctober 19, 2010 Appellate victory Working closely with Entergy's in-house lawyers, Thomas Flanagan and Andy Dupre successfully petitioned the Louisiana Fifth Circuit Court of Appeal to grant Entergy's expedited writ application on the eve of a significant trial. The appeals court reversed the district court's dismissal of Entergy's third-party claims against its statutory indemnitors. Of note, the Fifth Circuit declined to follow a decision it had issued only weeks earlier, which decision had formed the basis for the dismissal of Entergy's third-party claims at the district court.
