Supreme Court victory

Working closely with Entergy's in-house lawyers, Thomas M. Flanagan, Sean P. Brady, and Brandon C. Briscoe successfully defended the appellate court's reversal of a large judgment against Entergy Gulf States, Inc. Though the Louisiana Supreme Court granted the plaintiff's writ application to review the ruling, the Court unanimously affirmed and vindicated Entergy's position. Along the way, the Supreme Court rejected the continuing vitality of a 1970 Supreme Court decision addressing the appellant's burden in en banc cases, ruled that only one party's signature was sufficient to create a binding statutory-employer contract, and summarily turned away the plaintiff's argument that the relevant contract post-dated the accident. Rainey v. Entergy Gulf States, Inc., 2009-0572 (La. 3/16/2010).
